My father passed away 12 years back with no will. In year 2018 we 3 brothers made an unregistered family settelment but now my younger brother with bad intention not accepting family settelment saying it has no value and has started construction on some properties with the support of local gunda i ask him to stop construction till a legally valid partition done but not listening. All properties are in his possession I am in job and live in other city I only used to go home on occasions and to see my mother. I have been told that a co sharer can, t seek injuction aginst other co sharer for stopping construction then what is the remedy for other co sharer who is out of possession to get his legtimite share and restrict such construction so as not to change shape and status of property.

A.Hello Client,
Your Brother cannot do the same so you can file an FIR against him and hire an advocate to deal with then case.

A.Hi client,
Your brother cannot do the same, until and unless it is in his name. Lodge an FIR against him. Contact the Municipal Authority/ alternate authority and complain the same.

A.Dear Sir,
You may file partition suit or any other suit and get temporary injunction staying the construction of work proposed by your co-sharer.
