Seller cheated on land extent Seller cheated on land extent

I purchased a site in 2014. On sale deed, it measures 5.12 acres. I did not get the land surveyed until recently. After survey, I came to know, physically there is only 4 acres in actual. Seller cheated me on this front. Can I file cheating case against him?

Also, he is also threatening through his men that there is tenant act on that land and he has a paper to that effect. Whereas in the pahani, there is no mention of tenant at all. In the sale deed too, there is clause which talks about no tenant etc. What shall I do?
