Ancestral Property
My mother born in 1960 and her father died in about 1962. Ancestral property are divided among my maternity uncle. So now in jamabandi my maternity grandfather name is not their. Need help as my mother want inherit maternity ancestral property.
A.If your maternal grandfather died before 1962 and the ancestral property was divided among your maternal uncles, then it is likely that your mother's share of the property was also distributed at that time. However, to be sure, you can check the property records to see if your mother's name is mentioned as a legal heir.
If your mother's name is not mentioned in the property records, she can claim her share of the property by filing a partition suit in court. In such a suit, the court can determine the shares of each legal heir and partition the property accordingly.
Thank you
