Our father had purchased a citb property in the year 1979 from the original allottee. Subsequently my father died interstate during 1994 and my mother expired during 2029. Now we have got the khatha transferred in our names (three sons). Now we intend to dispose of this property and the purchaser is asking for sale deed from bda in our father's name. What is the remedy. How can get a sale deed in my father's name who is no more

The facts which you have provided is little bit confusing because you said your mother died in 2029. And as for your question of how to transfer sale deed you should visit the sub-registrar’s office with all available documents of the property, death certificate of the father, legal heir certificate to get the sale deed transferred in on your name. After a successful transfer in your name, you will be able to sell out the property further.

You may get issue a legal notice to BDA and if no reply is received then file a suit for specific performance and see that sale deed is executed either by BDA or Court Agency.
