I and my brother jointly own agricultural property. There is a court case on this property which is put up by my uncle. Due to conflicts between me and my brother we are not able to handle the case properly. So I want to file a partition suit to divide the property and handle the case separately.
So, is it possible to file a partition suite when there is a case on the property?
is it possible to file a partition suite even when my brother is not interested in partition?

A.Dear Sir/Madam,
If earlier suit was not for partition then you can file such suit even if your brother not interested to get partitioned,

The earlier suit put up by my uncle is the "Injection" suit, which is still ongoing. Court has not yet granted the injection order. So, still can I file the partition suite?
