Builder has pending maintenance of around 20 lakhs from few flat owners as they were unable to pay during covid times. Builder is not ready to take legal actions against these property owners and also not ready to handover the property to the people living in the residence. He is not allowing us to take the charge of the building or form the society. Those who have pending dues are not willing to pay as the builder is quite. I want to know the way we can pressurize the builder to handover the society to us and take the ownership. We want the builder to collect the outstanding from the Debtor. Builder has already failed to fulfill the promises in the past and now delaying the transfer of the property unneccessary.

A.Dear Sir,
You may lodge complaint with concerned licensing/registering of flat owners Associations so that they issue a notice to get it registered.

A.It appears that Builder is basically engaged in unfair trade practices. He got no right to prevent the flat owners from the formation and registration of an association to protect the common interest of all the flat owners.
Reach out to the Housing Deptt of the State Govt. and file a complaint jointly with all flat owners explaining therein the facts and the crisis facing by them in the matter to resolve the matter.
