The seller is forcing me to wait to get my advance money back. He told me before that he will return my money if we are not proceeding. now he is denying he said so and forcing me to stick to the agreement. As per agreement he is saying to wait until he sell it to another party and he will return the money. The statement exactly as per the agreement is "The 1st party/seller shall be entitled to deduct a sum of 10,000/- only as cancellation charges and balance amount shall be refunded to the 2nd party/purchaser within 60 days or after resale of the flat which comes later". I would like to know anyway i can get my money back before he sells his property or if any legal provision i can take. Thanks

A.Hello,
As per the information you have mentioned , If the sale agreement was not made on a registered document then you cannot enforce it in court of law,, however you can get refund of advance amount with interest but for that you have to state strong reasons before court.

A.Dear Sir,
You have two options. You may first to go to the Police Station and summon that person and try to get atleast postdated cheque otherwise you may get issue a legal notice and file a suit for recovery of such amount with interest.
