A.Dear Client,
Desertion is one of the grounds of divorce under Section 13 (1) (i-b) of the Hindu Marriage Act 1955. Desertion means forsaking or abandoning one spouse by the other without reasonable cause and against the wish of the other for more than two years. In a marriage, if one spouse leaves the matrimonial alliance without any sufficient cause he is said to be at ‘fault’. So reach out to an Advocate for filing a divorce petition before a family court against your husband if he deserted you for more than two years seeking a hefty amount of alimony/maintenance.
