Land acquired in 2009, award amount is not deposited , stay order issued and still land title changed to Government without giving single rupee

A.Dear client,
Generally, land acquisition is invalid if the compensation is not paid to the owner. Please file a suit in the court against the government for claiming higher compensation or for restoring your land

The government has the authority to acquire your land in order to develop infrastructure or economic zones under The Land Acquisition Act of 1894 which was replaced by the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation, and Resettlement Act. 2013. In a landmark judgment delivered by the Supreme Court in Pune Municipal Corporation & Anr. v. Harakchand Misirimal Solanki & Ors., it has been held that the acquisition of land under L A Act, 1894 would be deemed to have lapsed for non-payment of compensation to the land owner and would now be covered under the Act, 2013 law entitling the landowners to higher compensation if compensation for land acquired by the state under the 1894 Act has not been paid to the land owner or his/her legal heirs.
