I got married in 2020 and he's completely different attitude. There's no concern for my opinion from him or his family. I gave birth to baby boy and eventually got some health issue . My husband or his family are not in touch with me till date and i don't know what their intention is. It's been more than an year and I started to like someone else. How do I know their intention and how do I seek for divorce

A.Dear Client,
Desertion is one of the grounds of divorce under Section 13 (1) (i-b) of the Hindu Marriage Act 1955. Desertion means forsaking or abandoning one spouse by the other without reasonable cause and against the wish of the other for more than two years. In a marriage, if one spouse leaves the matrimonial alliance without any sufficient cause he is said to be at ‘fault’. So reach out to an Advocate for filing a divorce petition before a family court against your husband if he deserted you for more than two years seeking a hefty amount of alimony/maintenance and custody of the baby boy.

A.Dear client,

Consult with a family law attorney: Seeking legal advice from a qualified family law attorney is crucial when considering divorce. They can guide you through the legal process, explain your rights and options, and provide personalized advice based on the laws of your jurisdiction.

Document your experiences: Keep a record of any incidents, lack of support, or neglect that you have experienced from your husband and his family. This documentation can be useful as evidence during divorce proceedings.

Communicate your concerns: If you haven't already, consider expressing your concerns and frustrations to your husband. Effective communication may help clarify the intentions and expectations of both parties. However, if your attempts at communication have been unsuccessful or if you feel unsafe doing so, prioritize your safety and well-being.

Gather evidence: If you believe that your husband or his family's actions or behavior have been detrimental or abusive, gather any relevant evidence, such as emails, text messages, or witness statements, to support your case.

Seek emotional support: Going through a difficult marriage and contemplating divorce can be emotionally challenging. Reach out to trusted friends, family members, or support groups to help you cope with your emotions and provide guidance during this time.

Remember, seeking the assistance of a qualified legal professional is essential to understanding the specific laws and procedures that apply in your jurisdiction and to ensure that your rights are protected throughout the divorce process.
