I have paid a token money of Rs. 55,000 as token money to a reseller of flat . How ever he has unilaterally gone ahead and imposed a time frame for payment which is too short ad not feasible for me. Hence now I want refund of the said payment. What legal remedies do I have?

A.Dear Sir,
You may get issue a legal notice expressing your intention to refund his amount and to cancel agreement/contract with him.

A.Dear Client,
If the token money was given to the reseller of the Flat on the basis of an agreement to sell, then the conditions of said agreement are applicable to both parties. The reseller can not amend the condition and schedule of payment of the rest/balance of the consideration money unilaterally without the prior consent of the Buyer. So, you need to serve a legal notice to the reseller and file a suit against the reseller for specific performance before the Civil Court. Reach out to an Advocate for guidance and steps.
