Regarding my neighbour construction trouble

My neighbour is constructing,he dnt use tarpaulin and makes sand and cement dust,we asked them to clean at that time they said they will....after a week they dnt response so texted her husband who lives abroad about the cleaning stuff....so my neighbour started scolding me and used cast name to scold me....and later workers clamed down by saying that they will clean whenever they make dust....but they are not cleaning for 2 days...and we said dnt need u can clean for 2 days once...but even for that we have to request them or else stand out and shout for cleaning our house.....we are renting upstairs,ppl live there it wasz past 2 days still they dnt clean....may i know how can i solve tis
This is utter nuisance and an infringement of the right to privacy .If this type of harassment is faced by you from your neighbor then, you can file an application under Section 268 of IPC in the court of magistrate. Punishment of nuisance is defined in Section 290 of IPC, which is Rs. 200 but the court can do much more.

Thank you so much sir,but actually we insisted them that will make it legal at that time they said to remover the drainage opening straight to their house but on main road,while their heavy construction vehicle comes our drainage pipe which we laid on main road,where we made a connection before many years ,but we are not using it now...ours is last house (3)in this street theirs is (2nd).while we are constructing no buildings at that time we gave money to connect drainage pipes to the whole main drainage which actually government should make because its developing street we did that ourselves....but even though they broke the pipe and took all the sand we places on that ,we are ready to cover that opening but we cannot change the pipe,as its very expensive and we already laid pipe even from main road to coonect for them to...is it ok file complain at this tage
