Contested divorce case

Hi, after my delivery my husband did not want to live with me for some misunderstandings. He filed divorce case in 2021 under cruelty and I filed maintenance and RCR. maintenance case is stil not actioned upon and now my lawyer is telling as per new rule by HC ( as on June 2023) , the court will grant divorce in favour of my husband even if the alimony is not finalised. Is this true? Will court grant divorce without hearing my side just because my husband do not want live with me ? (Also we got married in 2019 and had baby within 9 months so on an average I lived only for 8 months.After delivery I am not living with my husband because he did not want me to )

Let us tell you that the Court cannot pass any order without hearing both sides. This is one of the principles of natural justice. Both the parties have to make a representation before the court. The Court cannot grant him divorce till it has heard your side of the story as well
