3 owners of flat. One has occupied but denies to give rent

My mother, my sister and I together own a flat in Pune. my married sister and her family stays there from last 15yrs. No agreement or no contract is signed between anyone.My sister gives just nominal rent to my Mom but has not given to me and does not intend to give and feels the flat is all hers now .. I did not fight for years thinking she is family.But now it's going too far and want to do something... What can be done and what does the law say..

A.U should file eviction suit against them. Otherwise settlement must for u .

A.As she is one of the title holder, she cannot take the place of tenant. Send a notice demanding fair rental value retrospectively and to hand over the vacant possession of the property.

You get an eviction order from the Court and say that she is your tenant on oral tenancy terms. If you take any other contention then eviction will be complicated.
