SBI is taking Physical Possession SBI is taking Physical Possession

This is hereby informed that I have a home loan account number 35925258576 that has been running since 2016... Due to some unavoidable circumstances, I lost my job in March' 2017 and survival was really very hard, due to that I was unable to pay some EMI's and my account was turned into a NPA account.

In Sept' 2018, by the staff of SBI, I was asked to pay the amount of 1,82,000/- to regularize my NPA a/c and to regularize I have paid 2,00,000/- after arranging the fund in such a crisis period. Although, it was misleading by the bank and my a/c was not regularized whereas I was asked to pay more of 1,65,000/-. To regularize my a/c, I have paid the same to the bank but still the bank didn't regularize and forced me to pay all the dues instantly. But, after the discussion, the bank allowed me time to repay my dues in a smooth manner. I have asked to clear my dues as early as possible and I have enclosed a copy of all the written documents between me and the bank. Things are fine till now but two months ago, one of the staff named Sunil Diwakar, called me and threatened to repay all the dues. Otherwise he will get me out of my home. Later he visited my place and sought me and my family. He also mislead by saying that I haven't paid any amount from the last 3 years but after assuring that I have paid my dues through my Kotak bank account as EMI, he said that won't work and I have to pay the full amount. He has stopped my ECS account so that I can't pay it anymore emi's. Now he has send a possession notice to me to vacate my place or clear my dues. I requested him to continue my EMI's but he denied and asked to repay complete amount. After pandemic, survival is worsen then earlier, on a humanitarian ground I have requested in all possible manner but he used to threaten. Now I was forced to share my bad experience to the higher authority so that I can get some solution to repay my account as early as possible. I am not getting why my account was not regularized after paying 3,65,000/- in 2018. Me and my family is suffering through depression due to such tortures' created by bank. My wife is working as a teacher in school and I am working as a freelance interior designer. We are not in a position to repay the dues of around 17,00,000/- in one go but I can assure to clear my emi's on time. My intention is to pay all the dues to bank but for that me and my family must have to be alive.

A.Dear Client,
Here are steps you might consider:

Document Everything: Collect and organize all documentation related to your home loan, including loan agreements, payment receipts, correspondence with the bank, and any written communication with bank staff. These documents will be crucial in supporting your case.

Contact the Bank in Writing: Write a formal letter or email to the bank's customer service or grievance redressal department outlining your concerns and grievances. Explain the history of payments and the issues you have faced with the bank staff's behavior.

Seek a Meeting: Request a meeting with the bank's senior management or branch manager to discuss your situation in person. Be prepared to present your case and provide evidence of payments made.

File a Complaint with Banking Ombudsman: If you are unable to resolve the issue with the bank directly or are not satisfied with their response, you can file a complaint with the Banking Ombudsman, an independent authority that handles grievances against banks.

Consult Legal Counsel: Consider consulting with a lawyer who specializes in banking and consumer law to assess your legal options and guide you on the best course of action.

Continue Paying EMI: If possible, continue paying your EMIs as per the agreed schedule, even if the bank has stopped the ECS. This demonstrates your willingness to repay the loan and may be beneficial in your discussions with the bank.

Seek Mediation: In some cases, mediation or negotiation with the bank may help reach a mutually agreeable solution. Mediation can be pursued independently or through a mediator appointed by the Banking Ombudsman.

Complain to Regulatory Authorities: If necessary, you can also file complaints with regulatory bodies such as the Reserve Bank of India (RBI) and the National Housing Bank (NHB) regarding the bank's conduct and handling of your loan.

Remember that resolving disputes with financial institutions can be complex, and it's crucial to seek professional advice and assistance as needed.
Thank you.
