Property Dispute Property Dispute

We have an ongoing Property dispute between My father his elder brother and Sister from 2013 in the Bombay High Court. As a peace deal we have made 2 out of court settlement 1 on plain paper singed between 3 siblings and one on a 500Rs Stamp paper and registered and also submitted to the court.

after the passing of My dad's elder brother the family is trying to deny the paper saying that we don not accept the paper and will not go with the settlement further. How can we tackle this and get the court to fast tract this application?

A.Dear Client,
Here are some general steps you may consider:

Consult Your Attorney: Contact your attorney who is handling the property dispute case in the Bombay High Court. Share the details of the out-of-court settlements and the family's current denial of the settlement.

Review Legal Documents: Review all the legal documents related to the property dispute, including the out-of-court settlements, any court orders, and other relevant paperwork. Ensure that the settlements are properly drafted and legally binding.

Mediation or Negotiation: Consider engaging in mediation or negotiation with the family members to attempt to resolve the dispute amicably. Mediation can be a faster and more cost-effective way to reach an agreement.

Seek Enforcement: If the family members are denying the validity of the settlement agreements, consult with your attorney about pursuing enforcement of the settlements through the court. The court may issue orders to enforce the agreements.

Petition for Fast-Tracking: Speak with your attorney about petitioning the court to expedite the property dispute case, especially if there is a genuine dispute and the family members are not adhering to the settlements. Your attorney can help prepare the necessary documents and arguments to request fast-tracking.

Legal Remedies: Explore any legal remedies available to enforce the out-of-court settlements, such as filing a specific performance lawsuit to compel the family members to honor their agreements.

Evidence and Witnesses: Collect any evidence or witnesses who can attest to the validity of the out-of-court settlements and the family's prior acceptance of the terms.

Stay Informed: Stay informed about the progress of your case by regularly communicating with your attorney and attending court hearings as required.

Remember that property disputes can be complex and time-consuming, and legal processes can vary based on the specific circumstances and the jurisdiction in which the case is being heard.
Thank you.
