A.Dear Client,
In India, divorce and alimony matters are governed by various laws, including the Hindu Marriage Act, the Indian Divorce Act (for Christians), the Muslim Personal Law, and the Special Marriage Act, among others. The specific law applicable to your friend's situation depends on his and his spouse's religion and the type of marriage they had. In many cases, couples are encouraged to explore mediation or negotiate a settlement to resolve their differences amicably, which can help save time and legal costs. If the spouse has filed a counter case, your friend should prepare a strong defense with the help of his lawyer. The court will consider evidence and arguments from both sides. The court will consider various factors when determining alimony, including the financial status and needs of both parties, their respective contributions during the marriage, and their earning capacities. The fact that she is educated and employed will likely be taken into account. The court will aim to provide a fair and reasonable maintenance amount.
