Sir/Madam
I availed road side assistance of tata motors in May 2018. They came with a faulty POS machine for card payment. I didn't know that and I swiped my debit card twice. Because the machine was not responding, I paid the service charges by cash. But, later, I received notifications from my bank that both my debit card transactions were successful. So I contacted tata motors customer service. They responded well initially, but stopped replying to my e-mails and phone calls. So I filed a complaint in consumercomplaints.in. Again, tata motors did not respond well. I would like to know how to proceed with this as a case in consumer court and get my refunds.

A. You can Consumer Complaint in Consumer Forum against that servicing center and Tata Motors company for deficiency in service.It is required to file complaint as early as possible.Therefore you need to get Bank statement from your Bank.And also bill/receipt from servicing center.But you can send legal notice prior to filing of complaint against those.

A. You can send a legal notice for refunding the excess amount received by them, unless they refund you, you can claim money from consumer Court and as well as seek justice from Reserve Bank of India for adjudicating your dispute under The Payment and Settlement Systems Act 2007.

A. Dear Sir,
If they did not respond then the award will passed by the Consumer Forum in your forum and then execute it and get the amount. They never bother and their non response indicates that they have committed a mistake.

A. If u has been filled case before counsumer forum then send legal notice through lawyer

A. You have made complaint to wrong consumer Website. This is not official website of consumer court. You have to make complaint to cms.nic.in. This is official website of consumer forum or make complaint maually. By filing proper complaint. Or check proper consumer district Forum in your area.
