A.Dear Client,
Under the Land Acquisition Act, 1894 the union or a state government is empowered to take private land for public purposes and to compensate the original owners and other persons affected due to such acquisition. The Right to Challenge Land Acquisition lies only with the Original Owner, Not with Subsequent Buyers. According to a recent judgment related to the land acquisition, the Supreme Court of India has given a judgment that only the original owner of the land has the right to challenge the land acquisition. So, if you are the original owner of the property, then on receipt of notice from the Municipal Authority, you need to take up the matter with the authority to resolve the issue otherwise for unauthorised construction, you may face legal consequences.
