A.Dear Client,
HIV is a sexually transmitted infection, but it can progress to a disease called acquired immunodeficiency syndrome (AIDS) when HIV infection is untreated and known as venereal disease which is a ground of divorce amongst others as stated under Sec.13 of the Hindu Marriage Act, 1955. If one of the spouses is suffering from a serious disease that is easily communicable, a divorce petition can be filed by the other spouse. The sexually transmitted diseases like AIDS are accounted to be venereal diseases. Sec.12 of the Act deals with voidable marriage. Under Sec.12(1)(c) of the Act, a petition seeking nullity of marriage shall be entertained if (i) the petition is presented more than one year after the force had ceased to operate or, as the case may be, the fraud had been discovered. A.Dear Madam,
If one year is not completed you may seek nullity of marriage under Section 12 of Hindu Marriage Act even otherwise you may go for Divorce with huge alimony.
