Grandmother had 5 flats. Out of this 4 she gifted to her children and kept 1 for herself. This she did in front of 1st class magistrate affidavit. Then she made a gift deed for one of my parents. Soon after my parent passed away without registering the gift deed. Now I want to transfer the flat given to my parent to my name. What to do? (Grandmother alive)

A.Dear Client,
A deed of gift becomes infructuous and invalid once the donee expires before registration or accepting the gift from the donor. When your Grandmother is alive, she may consider gifting the said property to her grandchildren on the demise of her own children. Once your grandmother agrees, a fresh deed of gift in respect of the said property may be executed and registered in your favor in compliance with the procedures of registration.
