I have purchased a flat which has old maintenance dues. The flat was closed for about 8 years and now i have cleared all the dues. But during the time when the flat was closed and and maintenance was not being paid, few services were given to the flat owners by the RWA. Now because I have cleared all the old dues, I am asking the RWA to give me the services which were not provided against my flat due to non payment of dues. But the RWA is ignoring my requests and not giving any proper response. What remedies do I have in this situation? People who are governing the RWA have formed a group and they take decisions as per their convenience. If they need any service, their requests get attention and get done from the back door.

A.Dear client, you can make a complaint to the managing committee (governing body) regarding this issue. If there is no resolution of the issue then make a complaint to the registrar of societies. You can also file a complaint in civil court. The Registrar of Society can stop RWA from taking illegal steps against you, or suspend the governing body of the association.

A.Dear Client,
In the given scenario, being a member of a registered RWA, you should make an application to the Secretary/President of the RWA and get a receipt of the said application from the office of the RWA for documentation of your grievance. If they refuse to receive the application, send it by registered post for the same purpose. If no response to your application is received from the RWA, file a complaint before the competent authority, the state housing deptt with whom RWA is registered or the Registrar or Deputy Registrar of the Cooperative Societies, as the case may be, for a resolution to your grievance. Apart, you can file a complaint against the RWA for deficiency in service before the Dist. Consumer Forum seeking appropriate relief in the matter.
