A.Dear client, it is illegal to sell the lands of others with out their consent. Here, your grandfathers brothers cannot sell his land with out his consent. You can file a case for possession of the property.

A.These land matters are not so easy to resolve without looking at the papers and family tree. You need to understand the scenario in which they were able to sell. In case they had the legal right to sell then you cannot do anything if not then you can challenge the same in the court of law looking at other provisions of the law.

A.Dear Client,
Your query requires more details to address suitably. In the absence of the year of selling of your grandfather's property by his brother, it is difficult to suggest tentative legal action applying the law of limitation that barred a claim of the claimant. A grandfather's property is the ancestral property in the hands of the grandchildren and they are entitled to an equal share in the said property since their birth. In the given scenario, you need to file a civil suit for a declaration under Sec.34 of the Specific Relief Act, 1963 before the competent Civil Court seeking an injunction under Order 39 Rule 1 & 2 CPC read with Section 151 of CPC requesting the Court to exercise its inherent power to do justice. Reach out to an Advocate experienced in civil matters for guidance and steps.
