A.Dear Client,

Without an Agreement to Sell, your case for specific performance is somewhat weakened in court. However, with evidence such as transaction documents and eyewitness testimonies, along with a legal notice served to the seller, you can initiate a civil suit seeking specific performance. This entails requesting the court to compel the seller to register the property in your name. Without a registered deed of sale, you lack ownership rights necessary for selling the property.

A.Dear Client,
In the absence of an Agreement to sell, you transferred the value of the property to the Seller typically makes your case a little bit weak in establishing your claim for specific performance before the Court. However, based on the document of the transaction of money between you and the seller and the evidence of eyewitnesses, serving a legal notice, you can file a civil suit for specific performance against the seller seeking an order for registration of the said property in your favor. In the absence of a registered deed of sale in your name, you cannot sell that property without being the owner of that property.
