Does it matter if Mutual Consent Divorce (13B) is decreed by Lok Adalat or not ? Does it matter if Mutual Consent Divorce (13B) is decreed by Lok Adalat or not ?

My soon-to-be ex-wife has asked humongous amount of alimony to settle all the cases once and for all. I am supposed to produce the money by 16th April 2018. Judge has told that if I am not able to get the money by 16th, he will is willing to give 17th/18th/19th April as the next date as per need. Time which might be needed to arrange money, create FD for my kid etc. He said once the money is give to her, he will waive off the 6 months and give the decree same day.

Now there is going to be Lok Adalat on 22nd April 2018.

I am just wondering what should I do, Should get the decree on 16th (assuming money is arranged by then) and get this done. Or should I get the decree from Lok Adalat.

I have heard that Lok Adalat judgement are not challengeable while the decree given by normal session court judge is challengeable. (Mutual Consent divorce 13B)

Point is I am worried that after getting money, my (soon to be ex) wife can re-appeal and create more problems. So should I believe the judge who says that even the decree given by him before Lok Adalat is equally NOT challengeable.

A.dear client in your matter The decree given by Lok Adalaat is not challengable as because in Lok Adalaat cases are settled with the consent of all the parties.

A.The award passed by the lok adalath is final and cannot be changed or appealable. The settelment is derived by consensus of both the parties .But your wife can file an execution petition before the concerned for getting the award executed.
