how to legalize illegal house construction how to legalize illegal house construction

Our 3 families are having 3 different illegal constructions (90% constructions in our town are illegal) with 10-15 feet private road in the middle of around 10000sqft plot. There is one plot behind our land which do not have road to access. The owner of that plot is blackmailing us for giving him access through our private road. For that he filed writ petition in Mumbai high court to demolish our constructions. After that we have submitted application in municipality for legalization of our construction under Maharashtra Gunthewari Act 2001. But they rejected by saying that constructions can not be legalised according to 3 e ii (matter being sub judice) in 2001 act. There is no hearings in court till now. Can we use DCR act?
