Advise on Dispute Plot

Hello Sir,
I have purchased a plot on 26th October 2014. Now I am able to know the same plot has been sold by someone else to other person on 30th October 2014. But from last 18 years of EC record who sold to me is seems the legal owner. So my query is now, can I able to build house on that plot? Is there any chance that after I start building the other party will be file complain. If he files complaint then what will be happen? Can he able to file against me?

A.dear client in your matter You can only construct legally on some land which is yours in clear title. Since, the land in question is having ambiguity in title, it is recommended that you run the documents through a lawyer for an advice.

A.As is the law the first person who holds the title is said to hold clean & enjoyable title to the property. It is not always the sale deed to or agreement is clear title to the property.It should be entered in the title records. It is better to consult a property lawyer before you proceed further to guide & help you in all aspects and rights of property & legal requirement before approval/noc for construction activities.

A.Selling of same property for the second time without first transaction being rendered invalid, is cheating being an offence.At the same time , selling of property by a person who doesn't has a valid title is also cheating besides forgery for the purpose of cheating. If you have a lawful title being a bonafide purchaser, there is no legal hurdle in carrying out construction. In case somebody who has purchased same property for second time after you purchased it, can approach the police as well as civil court against the seller and not against you.
