Hi,
I purchased a flat and it was registered to my name on 23rd Sept 2015. However, after purchasing the flat, i was informed by the Managing Committee (Society Administration) of apartment that i have to pay the Pending Maintenance Charges of the Flat from June-2015 to Sept-2015.

I have not agreed to pay this maintenance as i was not the owner of the flat until 23rd Sept 2015 (Date of Registration). This matter is still not resolved between me, builder and the association even today, and we have had several rounds of unfruitful discussions already

While he MC has gone ahead and raised an invoice for me to pay the pending maintenance. Now, the new argument is, as my flat was registered in the month of Sept-2015, the MC thinks i am definitely liable to pay maintenance atleast for Sept-2015 and asking me to clear the amount for the same. However, as i registered my flat on 23rd Sept 2015, i am requesting the MC for a pro rated maintenance for only last week of the month. MC believes maintenance is always monthly basis and cannot be calculated prorated. So, what should be my stand here? Am i legally right in saying i want to pay only the pro rated maintenance for the month of Sept 2015 (From 23rd Sept 2015 to 30th Sept 2015) and not willing to pay for complete month?

So, please let me know if a new buyer should pay a pro rated maintenance for the month of purchase or should he pay the entire month's maintenance charges?

A.dear client in your matter You are requested to write a formal letter to the management stating your conditions and acceptance to pay the maintenance charges but on pro-rata basis. If they still deny, then you can take legal recourse.

A.Dear Sir,
Your argument is correct and a common man can understand your logic but the Courts have no patience and time to listen to you, it is only head ache for every one.
