A. Hi,
It id advised to you to file a counter suit for criminal defamation and criminal intimidation against them. Also, let the trial happen so that you can prove yourselves to the court.
If you feel that your lawyer is stalling the process, you can replace them.

is it permissible to seek advancement of a criminal case (that is, put up) for clarification of last order? i will be at a loss if the last order is not clarified before the next scheduled date.

A. It is permissible in law to seek hearing of a case by put up the only thing that need to be ensured is the allowing of the put up application by convincing the court of the need or urgency of the matter and how it would be against your bona fide interest if you choose to take up the matter on its scheduled date of hearing. Those are lawyers skill to convince the court and therefore it is suggested that you visit a competent lawyer.

A. Sec 107 Crpc deals with preventive action of the police and it is aimed at those people against whom the police seeks restrain by taking bond. There is nothing in law which prevent police from booking anyone under that clause if circumstances so dictates but it is equally true that the automatic slapping of anyone with S.107 crpc just because they are booked in some other case is totally abhorrent to the concept of criminal justice system.

A. Hi,
Persons making false claims can be punished under Section 209 IPC. You can make an application to the High Court to quash fake cases under Section 482 CrPC.
