I have given money to a person without paper work but with cheque.He is now not returning money. Is it anything I can do legally.


A. To give opinion, it is necessary to know when you have paid that cheque to that concerned person and whether there was any verbal understanding with you to pay interest upon that sum. Please take note that until and unless you give him proper demand notice for refund of that sum along with interest or not, then your claim may become time barred by efflux of time and then it will not be possible to file Money Suit.

You don't give the money unless until he shows you the proof. If he threatens you, please file a police complaint. You can sue him in court for mental harassment and criminal intimidation under IPC. Please contact a lawyer.

A. The rate of interest @6% per month is very unreasonable and against public policy and law. Report the matter to police for harassment and file suit for permanent and mandatory injunction against him. Through court resolve the matter.

Yes, he is eligible for a government job unless the nature of his job is such that it has to be done by a person with no liability or any such encumbrance. If there is such a condition, it would be mentioned in the job notification and otherwise, he is eligible.

Make sure you entered into an agreement with your friend before giving the loan. Also friendly loan are without interest and there is no provision to take interest charge on the same. If you give such loan charge interest on the same you'll also have to show it in your lender income tax return. You can absolutely give such loan and take PDC's as security.
you must sign the loan agreement on Rs.100 stamp paper in Delhi.
