You can send them a legal notice as there is a separate plan proposed by Reseve Bank of India(RBI), if the borrower is unable to pay EMI then he/she can opt for loan restructuring as per the resolution plan offered by his/her lending institution.

A. Hi,
The best thing to do is to file a complaint with the police for fraud and cheating. You friend's father is also a victim as he was unaware of the broker's real intentions. Civil money recovery proceedings can be instituted against the broker by all those who have been aggrieved by his actions. As the limitation period of three years has expired, they will also have to file an application for the condonation of delay, if they have genuine reasons for the same.

You need to file a well draft complaint in customer care to resolve your issue and you first collect statement of account check the details of payments adjusted and balance dues and file detail complaint before RBI ombudsman to get relief from arbitrary dues.
