Meri marriage ko 15 din ho gye ...meri wife mere ko bolti hai ke mera bf tha.. mein room mei v gyi thi but ajj family ke front pr woh sub kuj change ho gyi .... muje aur meri family ko khatra hai ke woh apne bf ke sath milkr muje aur meri family ko mar na de ....plz help me divorce kaise ho skta hai ? Ya wo mere ghr pr na aye aur apne ghr pr hi rahe. Mein ek govt employee hu aur wo mtech pass hai... plz help

A.Hi,
Divorce before completion of one year of marriage is not permissible, except for exceptional hardship situation.
Some advisories can be followed subject to circumstances --
Firstly, you may try for mutual divorce. If she is not agreed, or appears to be in a atrocious state of mind, then --
1. You may keep your neighbours and close nearby people associated with your family updated about the development and they should know very well that she is not subjected to any sort of cruelty or torture at your home. This will help in the event of any false police complaint filed against you and your family by her u/s 498 IPC.
3. If you feel that there is threat to life and if there is clear evidence to that effect or that she is continuing with her illicit relation and that there is evidence of threat to your life, you may consider filing a divorce on exceptional circumstances before one year of marriage.

A.In any case, admission is unknown to matrimonial cases. But both of you can go for divorce by mutual consent if whatever you have said is true. Though on ground of exceptional hardships divorce petition can be filed before completion of 1 year of marriage but the threat complained of have to be established by you, or you may be exposed to counter proceedings possibly making yourself liable for cruelty to wife/ defamation / fraud on court etc.

A.1. kyunki abhi tumhari shadi ko kewal 15 din huve hain to divorce to bhool jao,
2. sabse pahle to apne ghar ke bade/bujurgon ko lekar apni patni/sasural walon se baat karo aur yadi patni apni galti manti hai aur bharosa dilati hai ki aisa kabhi dubara nahin hoga aur tumhein lagta hai ki ek mauka dena chahiye to mauka de sakte ho,
3. yadi tum chahte ho ki talaak hi lena hai to filhaal use samjha bujha kar uske ghar bhej do aur 2-3 mahine ke baad ghar basane ka (section 9) ya divorce ka case daal do,
4. jab tum case file karoge to vo bhi maintenance, dowry act, gharelu hinsa ka case dal sakti hai,
5. RCR (section 9) ka case maintenance, dowry act, gharelu hinsa ke cases se bachaav karega,
6. uski aduletery ka proof agar koi ho to talak aasani se ho jayega

Vidhikarya ek achha platform hai clients ke issues solve karneka. App jhute issues post na kare. Kyunki 15 days me ye sab nahi hosktha. Let us think huva hai tho polic compliant karo koi evidence do. App government employee hai aur soch rahe ki kaisa chutkara paye. Agar us ko boy friend rahetha tho woh apne ghar chale jathi yahi tho aap bhi chahethe hai na. Ok my experience and your wording in the case is suspecting something. OK be frank at doctor and lawyer.

hamen sthiti jaanakar bahut afasos hua. main drdhata se muddon ko nipataane ke lie usake saath baat karane ka sujhaav deta hoon. choonki shaadee sirph 15 din puraanee hai, isalie talaak sambhav nahin hai. aur agalee prakriya annulment hai jise praapt karana aasaan nahin hai.
