Child maintainence

I got divorced 7yrs back by mutual consent. I have a 12yrs old son from that marriage. My ex husband deposited three Laks at time of divorce in my sons account and gave up his fatherhood rights. I was not guided properly and agreed as I was emotionally disturbed at that time. Can I claim for child maintainence now

A.mutual consent decree is final and can not be challenged thatswhy it is very important.
But SC maintained that dependents can ask maintenance later also even right of maintenance was givenup or change of circumstances.

A.Dear Madam,
You can file such maintenance application through your child in the giving background of developed circumstances as earlier paid amount is insufficient and you were misled by your husband.

As a mother you have every right to claim the custody of your child, ask your husband to give the custody of your child, if he doesn't agree for the same then issue a legal notice through a lawyer and file a petition in the court asking the custody of your child you will get a favor order from the court

A.As you accepted 3 lakhs for child . You can not claim child mentainance again. But there is some other option are available

A.Dear client, you should have limitation of time on it (usually a limited time would be given but crossed time it is max not possible) and Consult a family lawyer near your area.
