I realy need an advice. My husband has 1 elder brother and 2 elder sisters. The house that we live in is in the name of my mother in law. Father in law expired a year back. We were paying electricity and monthly expense amount of rs. 6000 since my marriage, but due to lockdown we are facing difficulties to pay them as my husband's job is lost. His elder brother works in an MNC IT company and earns in lakhs monthly. He wants to grasp the house in his own name and even mother in law is supporting . They have given us 2 months time to leave the house. When my husband is asking her to show the property paper,she denies and says she has the right to do anything and has even consulted a lawyer, who said them to make an affidavit and to take my husbands signature that by mutual agreement he is ready to leave the house and not claim anything. In return they will give Rs. 1lakh. the value of the property is approx. 56 lakh. Is there any provision to fight legally or the law permits them what they want to do.

A.First of all, you have to search the deed on the basis of which your mother in law is claiming her ownership. If in the contents of the deed, it is found that the property was not purchased from Stree-Dhan property and if the value of the property is paid by her husband then one partition suit may be filed before the competent authority claiming that the property originally belongs to there father, and at the time of purchase it was purchased in favour of the mother's name, but actually the property belonged to the father. So the legal heirs of the father,i.e, 2 sisters 2 brothers and the mother all are the equal owners of the property.

Better file a suit for partition if the property is not your mother-in-law's self acquired, ask your husband not to sign on any paper, you are also having proportionate share in the property
