A.Partition cases are excluded from the jurisdiction of the civil courts, (Section 171 (2) xvii and xviii)
of the Himachal Pradesh Land Revenue Act. The land partition cases are heard by a Revenue officer of a class not below that of an Assistant Collector, 1st grade (Section 138 of the Himachal Pradesh Land Revenue Act.) A qualified officer to whom the application has been presented can either conduct the whole enquiry himself or refer it, under Section 18(3) of the Himachal Pradesh land Revenue Act to a revenue officer of a lower grade
for investigation and report.
