My maternal grandfather has Ancestral property. Now my grandfather and my maternal Uncles have decided to distribute to the same property among themselves and they have no intention to share any of it with my MOM and my MOM's sister(Maternal Aunty). So what is the legal procedure that my Aunt and Mom have to follow now to claim their share in property. The region(Society) where i live its considered to be completely normal to not give any of the Ancestral property to Women. So please help me out here by giving your valuable advice. (Both my Maternal grandfather and grandmother are alive)

A.Hi,
All the heirs have equal right on the ancestral property regardless of the gender. You mom and aunt can file a claim for equal share in the property.

A.Hi,
As per the ruling of the Supreme Court, daughters also have an equal right to the property. Your mom and aunt can file an application for their share in the ancestral property. The property will be divided among all the heirs equally.

A.Maternal grandfather and grandmother are alive is irrelevant.
every heir have equal share in Ancestral property.
as per recent SC ruling, women have equal share as of son.
