We are 4 Brothers out of which 2 passed away, Now the property needs to be divided to the childrens,but one brother who is passed away his legal heir's are not showing intrest nor do they are ready to come, also they do not want any link with us.

Now how to proceed legally for 3 parts

A.Dear Sir,
You may approach Civil Court and file a Civil suit for partition.

A.file partition suit.'
they will get notice.
if they come then it will settle.
if they dont come then it will settle after some time.

A.What is nature of property? It is occupied by whom? Is the occupier ready to give ur share? If not you have to file partition suit. If other legal heirs are not ready you can go ahead for suit/partition to get your share.

A.Hi,
If there is no will then the property will be divided among the mother, wife and the children. Only if the above mentioned people are not existing then the property will be divided among the brothers. If you proceed then at a later stage the partition deed can be challenged.

A.Hi,
The children have the right over the property of their father. At a later stage they can come and challenge the partition deed so it is advisable to get a gift deed from the children if they do not want the property.
