After my father's death in 1999 all his properties are inherited by my mother, myself, married sister and one brother. Sister is not agreeing for division of property as she wants major share of properties of commercial value. Is there any way to divide the property as per existing law without her agreement?

A.Hi,
You sister cannot claim a major share, she has not right to do so. A suit of partition can be filed and the Court can award equal shares to all your father's legal heirs.

A.Hi,
The division has to be done with the mutual consent of all legal heirs. If they are unable to come to a consensus, a suit for partition can be filed and a Court will divide the property (or the proceeds from its sale) equally.

A.Division of property canot be as per wishes or desire of any particular person. If all agree only then with the agreement of all persons property can be divided by mutual consent. Father's property is liable to be divided in equal proportions among all legal geirs. You can file suit for partition in competent court.
