Nominee not paying money

Sir,
My husband died in road accident and he was having life insurance policies. In some of policies his father is nominee and he withdrawn the amount and not willing to give us. I have a daughter too. She is 1 yr. old. Please suggest how to recover amount from him.

You have a remedy of sending a legal notice to your husbands father claiming an equal share in the amount. However, as per the Insurance Laws (Amendment) Act, 2015 – If an immediate family member such as spouse/parent/child is made as the nominee, then the death benefit will be paid to that person and other legal heirs will not have a claim on the money. If he is not willing to pay the amount voluntarily, then you may file a civil suit for recovery of your husbands share from his father. If you find this helpful, please rate us.
