We are two sons of our father. I want to claim my property from my father who is willing to sell secretly and caught by me. He has already sold almost 1/3 of that property (Farming land) which is not self occupied by him. Now I want to save my 1/3 share...can i claim ?

A.Hai,
Yes, since he gets some right in it the moment he is born in that family. But he becomes a joint owner of that property with other members of that family and so can claim his right limited to his share in the property as per respective laws prevailing in India. A.Hai,
As has been discussed before, a son has coparcenary rights since birth. He can even claim his share in the ancestral property before his father dies, i.e. during the lifetime of the father (by way of partition). If you find this helpful, please rate us.
