What happens if I am unable to present myself in the court for the final divorce hearing. P.S: The divorce is mutual consent and the petition is filed 1 year back and we got the final divorce hearing date. It appears I may not be able to present for the hearing and I don't have a advocate representative in the case. The mutual divorce petition was filed by my spouses advocate on behalf of us.

A.Hi,
If there are valid reasons for non-appearance, then an ex-parte decree may be passed in your absence.

A.You can ask the lawyer to take another date for counseling and please note he is joint lawyer for representing you both since this is a mutual consent petition and/or even otherwise even if you don't ask to take date in the cases of mutual consent divorce cases don't get dismissed and usually Court grants another date but it is better to ask the lawyer to take another date stating your genuine reasons as otherwise it may affect your credibility in the Court of law if in case any legal hassels arrive in your matter in the future and ask the lawyer to take another date in writing vide email or message to avoid confusion.
