Declaration suit or legal heir certificate?

My parents died at 1980. We didn't get legal heir certificate as myself and my brother were minors at that time. We have one property in my mother's name. When we try to sell it, we are asked to produce legal heir certificate by the buyer.
What's the procedure to get legal heir certificate from the court and how much charges it would cost? One lawyer says We need to file a declaration suit and another lawyer says We need to apply for a legal heir certificate at court. Which one is correct? Declaration suit or legal heir certificate ? Please advice.

Since you are the legal heir of your mother, you can apply for a Legal Heir certificate under the District Tehsildar Officer via the District Court having the jurisdiction over the area.
You will require the following documents-
1. Name of the deceased person
2. Names and the relationship of family members with the deceased
3. Signatures of the Applicant
4. Residential Address of the Applicant
If you like it, do rate us.
