Hi Sir,
Iam chandana from visakhapatam. My mother had bought a land in 2007 at pedabodupalli.Recently we came to know that we bought the land from fake owner. We don't have an EC and we bought the land by good faith.we had only registered. We constructed a fencing in 2013 and we planted some trees in 2013.Later in 2012 two members had bought the and they never asked about the fencing and the trees.Even they were our relatives they never approached us regarding the land.Its been 13years we bought the land but no one had asked us about the possession of the land. Please suggest us about the recovery of possession of land or else we need the recovery for the compensation we had paid.

A.First you need to immediately contact a lawyer to prepare your suit for recovery of possession if you can satisfy the court that you are entitled to it. You case hangs on very fine balance and unless few facts stands in your favour it would be very difficult for you to recover possession in such cases. So without further ado immediately see a lawyer in person and explain your case and ask him/her to file a suit.

A.Since it is more than thirteen years hence though you can assert ownership by adverse possession but if somehow you donot succeed then you can lodge police complaint of cheating, misappropriation of funds etc against seller who defrauded you and can also file suit for recovery of damages and paid consideration with interest.

Recovery of possession of Immovable property. ... Section 5 of Specific Relief Act, 1963 provides that a person entitled to the possession of any specific immovable property can recover it in the manner prescribed by the Code of Civil Procedure, 1908

how 2012 comes later than 2013 ?
