Divorce ground

I have been married for 2.5 years with a daughter who is a year old now. I am seeking legal help for divorce on the grounds of sexual unsatisfaction, husband is jobless for over 2 years as well as domestic violence. However, I have been accused of having an extra marital affair. The man in question used to be my best friend and the messages that were sent to me were one sided as in I never said that I loved him or that I want to marry him. Now my husband says that my infidelity has triggered all these problems and still he is doing a favor on me by accepting me. While my reason for divorce is that I can't tolerate his mental torture for long.

he doesn't have any valid reason.
you can file both divorce and domestic violence case.

Cruelty can be inflicted on the spouse in various forms and this has been well recognized by the judiciary. Sexual unsatisfaction, false allegations, and no job come under Section 13(1)(a) and will be considered as grounds of divorce as they are acts which result in mental cruelty. Also, you should file a suit under Section 498 for Domestic Violence.

The ambit of cruelty in marriage, as a ground of divorce, is extended by the Courts. Sexual unsatisfaction, false allegations, and no job can each be considered under mental cruelty under Section 13(1)(a) Additionally, you can also file a separate suit for Domestic Violence under Section 498.
