Common passage dispute
Hi, Many years ago i had bought two plots on grassland.The two plots was around 45 ft away from a common road.Since my plots were 45ft away , the seller of the plots showed a common passage of 16ft which i have to use for entry to my home.There were no common passage built in then as it was a grassland.The common passage was of 16ft mentioned in affidavit and blueprint plan and was signed by the magistrate. After few years I purchased the plot which was nearer to the common road ie.45ft length plot.Now i have access to the common road.Together i now have 3 plots. Now,the owner of the land adjacent to that common passage is setting up a objection that the common passage is not ours anymore as in his opinion the common passage is not valid anymore and i now have the access to my home via common road.(((He is also telling that he will Build building using the 16ft common passage.))) And sir on the boundary wall adjacent to the common passage i have made holes which outlet is on common passage so that during rainy season water doesnot stag and flows out.The owner is also objectioning it. Sir what to do about it ? is the owner of the adjacent plot questionaable to the common passage of my plot.and if the holes of the wall for rainwater flow are illegal or not.
