I am 30 year old male. We( me and my mom) living separately from my father( he is a wife beater). 2 years back he sold ancestral property without our consent and now planning to sell rest as well. I want to know my rights as a son and my moms right as a wife on ancestral property. Should I got for partition deed. Please advise.

A.If the property is ancestral than he cant sell that property at his own. You may approach Honble court with a suit for partition with permanent injunction

Thanks for your reply. As I checked with the local area lawyer and he said you have no rights neither my mom, since the land is named after my father after my grand father died. Me and my mom only have share in house, there is no claim on land..

A.You challenge the sale of the ancestral property. Being a member of joint family HUF you have a share in the property unless it is self acquired property of your father. File partition suit.
