This house has some conman shareable parts like Stairs and water sever in ground floors.I am the owner of the ground floor. Earlier Me and my brother has court case and we close with an agreement.

But my brother without any knowledge to me has sold his part to third party. And even I don't know what sale deed both have done. I am afraid about my Ground floor and even this is my ancestor property should I have first call right to purchase the house.

A.It is necessary to go through your compromise order (or agreement between you and your brother) and also the sale deed. A copy of the said deed can be obtained by you if you first get an encumbrance certificate and trace the document No. through it.

I don't have encumbrance certificate. Even this sale was done without my knowledge and involment . What I can do in this case?

A.If the property is sellable in floorwise and it had been partitioned between both of you than you cant stop him from selling that property.
Yes if that third party who purched the property causes any type of nuisance than you may approach the Honble court to restrain him from doing so

A.What are the terms of the agreement by you and your bother. If it is ancestral property then all heirs have equal share.
