My father died recently. Now half of our ancestral land is under my mother and the other half is divided equally amongst me and my siblings. In the legal document, it is written that once my brother's son turns 18, all the land which is under my mother will go to him. So, me and my other siblings will not have that land which was under our mother. So my parent's land is being given directly to my nephew. Is this fair? (Also, the land under my mother will only be under my nephew because he's the only male child amongst the children of me and my brothers. It is not fair for my daughter and nieces.)

A.Dear Sir,
It all depends upon the nature of property and it should not be more than share of your grandfather. He cannot wait such a Will or document since he is the owner of only portion of his share.

A.Aap disputed documents ko court me challenge kare. Kyonki pusteni property ko dada ji transfer nhi kar sakte usme jo real uttradhikari hai vah adhikar rakhte hai.
Isliye aap ko sare fact likhte hue case file karna chahiye.

A.hi,
If it's not the land purchased by your father and it is an ancestral land then you could file a civil suit of partition and could have equal share in the property. As per the Hindu Law all the legal heirs must have equal share in the ancestral property. But if the land was purchased by your father and he given it daughter's child then you don't have much of a option.

A.This seems to inappropriate distribution of ancestral property which is not as per the Hindu law of inheritance and you can challenge this in the court of law. You should get in touch with a good civil lawyer and file a partition suit in a civil court.

As per the hindu law if this land is your ancestral land then all the legal heirs must have equal share in the property. But if the land was purchased by your father then he has complete right over it to give it to anyone. So, if the land is the ancestral land then you could file a civil suit in the court for having equal share over the property.

A.Dear client,
You may challenge such documents in court or may file case of partition such portion of land. If such land had been inherited not exclusively purchased by your father. Before all you may discuss all about within your family members.
