My dad's brother divided property & registered partition deed without my dad signature .They have also changed patta with the partition deed. Also got loans with partition deed of their shares . Please advise the legally actions I can take on them. Also I have doubt whether I make Complaint to bank and take other legal procedures . Property was divided unequally .They got more shares and done registration . The partition deed was done 2010

A.Aap ko apni property ke liye partition suit file karna hoga. Our aapko partition deed ko bhi challenge karna hoga. Kyonki aap ke father property me brabar ke hissedar hai. Isliye unki anumati ke partition or deed nhi kiya jaa sakta hai. Our bank me ek complaint file kare sabhi ke khilaf ki inke dawara bank ko jhute kathan karke loan liya hai.

A.Dear Sir,
Why your father sitting idle all these years. Just file partition suit and also lodge complaint with Bank along with family tree stating that your father also having a share in such property and loan may be cancelled.

A.Hi,
A suit for partition is filed in a Civil Court having jurisdiction over the area where the property is located. If there are several properties, the lawsuit can be filed in any one of the courts. The partition suit results in a decree which ends the joint nature of the property.

A.Hi,
You need to approach a civil court with all relevant documents and file for partition. The property then has to be divided into metes and bounds before you can sell your share. As there is a dispute you need to approach the court.

A.Here two things have happened namely your civil rights on property have been taken away and at the same time fraud has also been committed. So, you can take action under both the laws- civil and criminal.
File a civil suit for partition and wherein you can claim that the earlier partition was wrong and committed fraudulently.
Secondly you can lodge a police complaint, if you wish of committing fraud and forgery and taking loan from the bank.
