After my father's death , all the legal heirs have transferred the property to me. My brother also stays with me on this property. Recently we decided to sell the property. Now my brother is denying to sell it.

Can I still sale the property ?

A.Dear Sir,
Absolute owner have all the right to transfer the property as he like. If the transfer made by all legal heirs is the valid transfer then you have right to sell the property.

A.Hi,
If the property is transferred and registered to your name with the consent of all legal heir. Then your absolute owner of the property. The transfer must be unconditional. You are required to take NOC for property under your name. Then you will be able to sell your property.

A.If all the legal heirs have transferred the property to you legally and validly then you are the absolute owner of the property and you have all the right to alienate the property in a way you want. Additionally you can get the NOC or discharge letter from all of them then it will be better for the all and the buyer will have more confident int the transaction.

A.Agar aap ko aap ke brother and sister ne written me likh kar diya hai vah bhi registered tab aap total property ko sale kar sakte hhai.Agar aisa nhi tab aap property ko sale nhi kar sakte hai.
Kyonki father ki death ke baad sabhi equal rights rakhte hai isliye aap property ko unki consent ke bina nhi sale kar sakte hai.

A.In such a scenario, it is necessary to see whether the property in question was completely and unconditionally transferred to you in a legal manner and all the necessary legal compliances were done. If the same is so done, any objection shall not hold water.

A.If the property of all your siblings has been transferred to your name by registered agreements than you are the lawful owner of the property and you can do anything with the same without requiring any permission from your any siblings but in order to avoid bitterness it is advisable that you try to convince all your siblings before selling off the properties if you want to maintain good relations with them. A.Dear Sir,
Catch hold of some prospective purchaser and sell it away as you are having valid NOC’s to sell the property. Thus, avoid future complications since your brother may approach Court and get stay order.
